1. Class Cancellations
Group Classes: Cancellations must be made at least 24 hours before the scheduled class. Late cancellations will incur a full charge.
Waiver for Medical Reasons: Late cancellations may be waived if a valid doctor’s letter (stating the date of absence) is provided within two working days.

1. Terms and Conditions of Use

   The following Terms and Conditions govern the rights and obligations between you and O:RIN.

2. Use of O:RIN Package

   1. The right to attend classes is personal to you only and you shall not give access to another individual unless prior approval has been obtained from O:RIN pursuant to the Extension/Transfer Policy set out on the front page of this Agreement.

   2. You are not permitted to use any machinery or equipment (the “Equipment”) in O:RIN premises, which includes 908 and 1906 Westlands Centre, without the presence and supervision of a licensed instructor of O:RIN.

   3. Under no circumstances should you move or use the Equipment in any manner not authorised by O:RIN.

   4. You shall pay for any damages to the Equipment resulted from you wilful or negligent conduct.

   5. O:RIN may close its premises and/or Equipment for seminars, certifications, maintenance, selected holidays and other hours based on the Special

      Administrative Region of Hong Kong government requirements. O:RIN may change, repair or replace any part or all of its Equipment without any

      effect on this Agreement.

   6. You shall not participate in any activities with O:RIN whilst suffering from any infections or contagious illness, disease or other ailment including but

      not limited to open cuts, abrasions, open sores or minor infections, where there is any risk that such use or participation in such condition may be

      detrimental to the health, safety, comfort or physical condition of other users of O:RIN.

   7. You shall conduct yourself in a well-mannered fashion so as not to cause any danger or disturbance which may interfere with the use and enjoyment

      by any other person present at O:RIN premises. You understand and agree to observe O:RIN rules and regulations and not to abuse the Equipment

      in any fashion.

   8. O:RIN may assign the benefit of this Agreement to any person, firm or company without notice to you.

3. Fees

   The fees payable by you are detailed on the front of this Agreement. Once you have signed this Agreement, you shall complete the agreed contractual

   period. All fees paid under this Agreement are non-refundable.

4. Reserved Right of O:RIN

   1. O:RIN reserves the right to add, amend or remove clauses in the Terms and Conditions from time to time at our sole discretion without notice or liability to you. You will be alerted to any changes to the Terms and Conditions by a notification email to the email address you have provided us with in this Agreement. By continuing to use the services following such amendments to the Terms and Conditions, you agree to be bound by such amendments.

   2. O:RIN may terminate this Agreement without notice and with immediate effect if your conduct is such that, in the reasonable opinion of O:RIN, it may be injurious to the character or interests of O:RIN or to other users of O:RIN or if you are in breach of the Terms and Conditions as from time to time are in force. All decisions of O:RIN under this clause are final and binding.

   3. The failure of O:RIN to exercise any of its rights at any time for any period will not be construed as a waiver of such rights.

5. Assumption of Risk

   1. You are aware and fully understand and accept that the use of O:RIN premises, facilities, equipment, services and programs includes an inherent risk of injury to persons and property.

   2. You represent that you are in good physical condition and have no disabilities, illness or other conditions that will prevent you from exercising and using the Equipment without injuring yourself or impairing your health. You have consulted a qualified medical practitioner about your ability to participate in the physical activities and/or use of O:RIN Equipment for those physical condition(s) you have listed in the Registration/Assessment Form annexed to this Agreement and any other conditions or under medication which you did not or failed to disclose in the Registration/Assessment Form.

   3. You agree to disclose to O:RIN any special exercise requirements or limitations before participating in O:RIN classes and/or using O:RIN Equipment; and when seeking help in choosing a class package.

   4. You should notify us and cease to continue the class if at any time you feel unfit, hurt, unwell or in any other way limit your condition or ability to continue.

   5. O:RIN is not responsible for any items lost or stolen on its premises for any reason whatsoever.

   6. No person who is under the influence of drugs or alcohol will be permitted to take part in in O:RIN classes and/or use O:RIN Equipment.

6. Limitation of Liability

   1. You voluntarily accept the risk of injury involved in activities with O:RIN. None of O:RIN, the management or any of its employees, shall be liable for any actions or legal proceedings due to death, injury, loss, damage or theft to a person or property arising out of, or in connection with, your use of any of the services or the Equipment of O:RIN (save in respect of death or personal injury arising out of the gross negligence of O:RIN, its management or its employed staff). You hereby hold O:RIN, the management and all of its employees and agents harmless from all claims which may be brought against them by you or on your behalf for any such claims as aforesaid.

   2. You hereby agree to defend, indemnify on demand and hold harmless O:RIN, any of its employees or agents from all claims which may be brought against them for any such injuries of claims as aforesaid and all costs and expenses incidental thereto.

   3. The above exclusions and limitations apply only to the extent permitted by the laws of the Special Administrative Region of Hong Kong.

7. Apparel

   1. You must wear appropriate clothing when participating in class.

   2. Socks must be worn for all classes.

8. Others

   1. You hereby authorise O:RIN to use and reproduce any photographs, personal narrative, interviews or audio and video recording of my participation for any and all purposes, without compensation.

   2. Your personal data may be used, disclosed, maintained, accessed and processed and/or transferred to the O:RIN auditors, legal advisors, or to any third party service providers as engaged by O:RIN including but not limited to those engaged by O:RIN to provide and maintain any IT equipment used to store and access your personal information.

   3. Lockers are provided for day use at no extra cost and shall be emptied at the end of the day and O:RIN shall be entitled to break open any such locker which remains unopened and/or left unemptied at the end of each day and remove the contents of such locker.

   4. The lockers should not be used for storage of valuable items and O:RIN accepts no responsibility for any loss or damage for locker contents for any reason whatsoever.

   5. The Agreement shall be governed and construed in accordance with the laws of the Special Administrative Region of Hong Kong.

   6. If there is any conflict between the English version and the Chinese version of this Agreement, including this Terms and Conditions, the English version shall prevail.
